Terms of Service

These Terms of Service ("Terms") are an agreement between you and Playdubious, a sole proprietorship based in Wisconsin ("we", "us"). They cover the game server hosting, the control panel at panel.playdubious.com and related services (the "Service"). By creating an account, paying for, or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refund & Cancellation Policy.

1. Who can use the Service

The Service is currently invite-only. You must be at least 18 years old, or the age of majority where you live, to create an account or pay. You may let others play on your server; you are responsible for how your server and account are used, including by the people you let in. Keep your login and two-step verification secure and tell us right away at [email protected] if you think your account was accessed by someone else.

2. What you get

We provide a game server with the resources (memory, storage, CPU share) and features described in your plan, managed through our control panel. We may change the underlying hardware, location or software as long as your plan's resources stay substantially the same. Game servers are unofficial and are not affiliated with or endorsed by Mojang/Microsoft, Facepunch Studios, Studio Wildcard, Bohemia Interactive, BeamNG or any other game publisher. You and your players must own legitimate copies of the games and follow each game's own license (for example the Minecraft EULA).

3. Payment

Plans are billed monthly in advance through our payment processor, Stripe, and renew automatically until cancelled. Prices are shown before you pay; we will give at least 30 days' notice by email before changing the price of an active plan. If a payment fails, we will let you know; if it is still unpaid 7 days after the due date we may suspend the server until it is paid. Cancellation and refunds are covered by our Refund & Cancellation Policy. If you dispute a valid charge with your bank instead of contacting us, we may suspend the account while the dispute is open.

4. Your content

You keep ownership of the worlds, files, configurations and other content you upload or create ("Your Content"). You give us permission to store, copy, back up and process Your Content only as needed to run the Service. You are responsible for having the rights to Your Content and for complying with our Acceptable Use Policy.

5. Backups and data

We make regular backups as a convenience, but backups are not guaranteed. Keep your own copies of anything important; you can download your files from the panel at any time. After a cancellation or a suspension for non-payment, we keep your server's files for at least 14 days so you can download them or resume, then we may delete them permanently.

6. Availability

We work to keep servers online, but the Service is provided without an uptime guarantee. Maintenance, updates, internet or power outages, attacks and events outside our control can cause downtime. Planned maintenance will be announced on status.playdubious.com or by email when practical.

7. Suspension and termination

You may cancel at any time (see Refunds & Cancellation). We may suspend or terminate your server or account, with notice where reasonable, if you break these Terms or the Acceptable Use Policy, do not pay, create a security or legal risk for us or others, or if we stop offering the Service. If we stop offering the Service without any fault on your part, we will refund the unused part of your current billing period.

8. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise the Service will be uninterrupted, error-free or free of data loss.

9. Limitation of liability

To the fullest extent the law allows, Playdubious will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnity

You agree to defend and hold Playdubious harmless from claims, losses and costs (including reasonable attorneys' fees) arising from Your Content, your server's use by you or your players, or your violation of these Terms or the law.

11. Changes to these Terms

We may update these Terms. If a change is material, we will email account holders at least 14 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Waukesha County, Wisconsin, and both parties consent to that venue. Before filing anything, please contact us; most problems can be fixed with an email.

13. Everything else

If a part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver. You may not transfer your account without our consent. These Terms, together with the policies linked above, are the whole agreement between us about the Service.
